These General Terms and Conditions govern purchases and bookings made through the Italygonia Travel website and, where applicable, through other sales channels used by Italygonia Travel.
Italygonia Travel markets tourist services and experiences in Italy, including, by way of example, guided tours, private tours, walking tours, excursions, food tours, wine tours, tastings, cultural and gastronomic experiences, private transfers, chauffeur-driven services, transportation services, combinations of services and package travel.
Unless otherwise stated on the relevant experience page, Italygonia Travel acts as the organiser of the service purchased.
Italygonia Travel may also market services organised by third parties. In such cases, the relevant experience page will identify the other entity as the organiser of the service, and Italygonia Travel will act as an intermediary or travel agent, as applicable under the law.
These General Terms and Conditions apply to purchases made by the customer together with any specific conditions stated on the relevant experience page and in the booking confirmation.
Unless another entity is identified as the organiser on the relevant experience page, Italygonia Travel is the organiser of the purchased service.
Where the experience page identifies another entity as the organiser, that entity is responsible for organising the service and Italygonia Travel acts as an intermediary in the sale.
The organiser identified on the relevant experience page is the entity responsible for organising the service, subject to the applicable law.
Where Italygonia Travel acts as an intermediary, responsibility for the organisation and performance of the service lies with the identified organiser to the extent provided by law, while Italygonia Travel remains responsible for the obligations applicable to its intermediary activity.
When acting as organiser, Italygonia Travel may use suppliers, professionals, companies and third-party operators for the full or partial performance of a service.
These may include, by way of example:
Italygonia Travel may select, replace and coordinate such suppliers according to its organisational requirements.
Where reasonably necessary, the originally planned supplier may be replaced by another suitable supplier, provided that this does not result in a material change to the essential characteristics of the purchased service.
Mandatory rights and protections provided by applicable law remain unaffected.
The relevant experience page contains the information concerning the service offered.
Before purchasing, the customer must carefully review the information published, including, where applicable:

Each experience may be subject to specific conditions concerning, among other things, cancellation, times, duration, meeting point, participation requirements, inclusions, exclusions and operating procedures.
The specific conditions stated on the relevant experience page and in the booking confirmation prevail over these General Terms and Conditions with regard to the matters specifically regulated therein.
Specific conditions may not derogate from mandatory rights granted to the customer by applicable law.
The customer may purchase an experience through the purchasing procedure available on the website.
Before completing the purchase, the customer must check the accuracy of the information entered and the characteristics of the service.
The customer must provide accurate, complete and up-to-date information and is responsible for any consequences resulting from incorrect, incomplete or outdated information.
Completion of the purchase procedure and payment of the required amount constitute acceptance of the conditions applicable to the purchased experience.
Following the purchase, Italygonia Travel will send the booking confirmation using the procedures provided during the purchasing process.
The confirmation will be sent to the contact details provided by the customer and will contain the information necessary to use the service.
The customer must immediately check the accuracy of the information contained in the confirmation and promptly report any errors.
For the purpose of issuing invoices and complying with applicable tax requirements related to the purchase, Italygonia Travel may request from the customer the information required under applicable tax law.
Depending on the circumstances, this may include:
The customer is responsible for the accuracy, completeness and up-to-date nature of the billing information provided to Italygonia Travel.
Personal data will be processed in accordance with applicable data protection legislation and as described in the Privacy Policy of the website.
The price of the experience is the price displayed on the relevant experience page at the time of purchase.
Any supplements, optional services, additional charges or services not included in the price will be indicated on the experience page or during the purchasing procedure.
The customer is responsible for checking the total price before completing the purchase.
For package travel, the specific provisions of applicable legislation also apply.
Payment must be made using the payment methods made available on the website.
The booking is subject to successful payment authorisation unless otherwise stated.
Italygonia Travel is not responsible for malfunctions, refusals or unavailability of payment systems that are not directly attributable to Italygonia Travel.
Each experience may have its own cancellation policy.
Depending on the product purchased, the applicable policy may provide, by way of example:
The cancellation policy stated on the individual experience page and in the booking confirmation prevails over the general cancellation provisions contained in these General Terms and Conditions.
Any statutory right of withdrawal applicable to distance contracts must be distinguished from the voluntary cancellation conditions applicable to the individual experience.
For certain categories of leisure services where performance is scheduled for a specific date or period, applicable legislation provides an exception to the ordinary right of withdrawal.
Where the right of withdrawal is legally excluded, the customer may nevertheless benefit from the cancellation policy stated on the relevant experience page.
The availability of free cancellation within a specified period does not constitute recognition of a statutory right of withdrawal where such right does not apply by law.
Package travel is subject to the specific provisions applicable to package travel.
The customer must arrive punctually at the meeting point and at the time stated in the booking confirmation.
The customer is responsible for planning their arrival taking into account traffic, parking, public transportation, delays affecting transportation services, security checks, weather conditions and any other circumstances that may affect arrival time.
In the event of a no-show, arrival after the departure of the experience or a delay incompatible with the performance of the service, Italygonia Travel may consider the service unused due to the customer’s responsibility.
In the event of a customer no-show, the amount paid will not be refunded, unless otherwise stated in the specific experience conditions or where mandatory rights under applicable law provide otherwise.
Requests to modify a booking are subject to availability and the conditions applicable to the specific experience.
Italygonia Travel does not guarantee that a confirmed booking can be modified.
Where a modification is possible, additional costs or price differences may apply and will be communicated to the customer before the modification is confirmed.
For organisational, operational, logistical or safety reasons, Italygonia Travel may make non-material changes to an experience.
These may include, by way of example:
Italygonia Travel will endeavour, where reasonably possible, to maintain the overall nature, duration and value of the service.
Package travel remains subject to the specific provisions of applicable law.
If Italygonia Travel, for organisational, operational, safety or other reasons preventing the experience from taking place, has to cancel the service, the customer will receive a refund of the amount paid for the cancelled service, in accordance with the applicable procedures.
Package travel remains subject to the specific provisions of applicable legislation.
To the extent permitted by law, Italygonia Travel shall not be liable for the inability to perform, or modifications to, an experience directly resulting from unavoidable and extraordinary circumstances or circumstances beyond Italygonia Travel’s reasonable control.
Such circumstances may include, by way of example:
Package travel remains subject to the specific provisions of applicable legislation.
Where Italygonia Travel acts as organiser, it is responsible for the organisation of the service within the limits and under the conditions established by applicable law.
To the extent permitted by law, Italygonia Travel shall not be liable for consequences arising from circumstances exclusively attributable to the customer, including:
Italygonia Travel shall not assume liability exceeding that provided by applicable law.
Nothing in these Terms and Conditions is intended to exclude or limit liability that cannot legally be excluded or limited.
Where the experience page identifies another entity as the organiser, Italygonia Travel acts as an intermediary.
In such circumstances, the organisation and performance of the experience are the responsibility of the entity identified as organiser, subject to the applicable conditions.
Italygonia Travel is responsible only for the obligations imposed on it by applicable law in connection with its intermediary activity.
Experiences marketed by Italygonia Travel may take place in environments and territories with very different characteristics, including historic centres, hilly and mountainous areas, high-altitude locations, paths, routes with elevation changes, stairs, uphill and downhill sections, uneven or rough surfaces, unpaved roads, rural areas, archaeological sites and other locations that may require particular physical or motor abilities.
The customer must carefully read the description of the experience and all information available on the relevant product page before making a purchase.
Where appropriate, the customer must also independently obtain information about the location and territory where the activity will take place, including through websites, maps, official tourism sources, local information and other publicly available sources.
The customer must independently assess, taking into account the information published by Italygonia Travel and any additional information that can reasonably be obtained, whether the experience is compatible with their own abilities, requirements and personal circumstances.
This assessment must also be made for all participants included in the booking.
A customer who makes a booking for several people is responsible for verifying in advance that each participant is able to take part in the experience having regard to its characteristics.
The absence of a specific age limit, difficulty rating or physical requirement on the experience page must not be interpreted as a guarantee that the experience is suitable for every person.
The customer must therefore take into consideration, among other things, the location, altitude, terrain, itinerary, duration, distances, elevation changes, stairs, uphill or downhill sections, uneven surfaces and any other characteristics that can reasonably be identified from the available information.
To the extent permitted by law, Italygonia Travel shall not be liable for consequences arising from a person’s participation in an experience that is unsuitable for their abilities or circumstances where those characteristics could reasonably have been assessed before purchase.
Where specific requirements or restrictions are stated on the product page, compliance with them is a condition of participation.
Unless otherwise stated on the experience page, minors must be accompanied and supervised by a responsible adult.
The person making a booking for a minor is responsible for verifying in advance that the experience is suitable for the minor and that any requirements stated on the product page are met.
Any age restrictions specifically stated on the experience page prevail over these General Terms and Conditions.
Transfers may be provided directly by Italygonia Travel or through NCC operators, drivers, transport companies or other suppliers.
The vehicle described may, where necessary, be replaced by a vehicle of equivalent category.
The customer is responsible for providing accurate information concerning:
Italygonia Travel shall not be liable for consequences resulting from incorrect or incomplete information provided by the customer.
Where a product meets the legal definition of “package travel” under applicable law, the provisions of the Italian Tourism Code and applicable European legislation on package travel shall apply.
The inclusion of several services within the same experience does not automatically mean that the product constitutes package travel.
The legal classification depends on the actual structure of the offer and the manner in which the services are combined and sold, in accordance with applicable law.
Where Italygonia Travel organises a package travel arrangement, it assumes the obligations and liabilities established by applicable law for the organiser.
Italygonia Travel may market experiences consisting of several activities or services.
The combination of several elements must be assessed according to the actual structure of the offer and applicable law.
Not every combination of services necessarily constitutes package travel.
Where an experience qualifies as package travel, the specific provisions applicable to package travel shall apply.
For every product that constitutes package travel, the relevant experience page will provide a link to the following page:
“Traveller Information and Rights – Package Travel”.
This page will contain the information and rights required under the legislation applicable to package travel, together with the information that must be made available to the traveller before purchase.
For package travel, such information supplements these General Terms and Conditions.
For package travel organised by Italygonia Travel, protection against insolvency will be provided in accordance with applicable law.
The scope of the protection, the applicable guarantee, the guarantor and the procedures for activating the protection shall be those established by the applicable guarantee and by law.
The relevant information will be made available to the traveller in accordance with applicable legal requirements.
Insolvency protection is separate from Italygonia Travel’s professional liability insurance.
Italygonia Travel holds professional liability insurance with Europ Assistance, policy no. 2275327.
Coverage is subject to the terms, conditions, limits, deductibles and exclusions established by the relevant insurance policy.
Professional liability insurance is separate from the insolvency protection required by law for package travel.
If the customer encounters a problem during the service, the customer should, where possible, promptly notify Italygonia Travel or the contact person identified in the booking confirmation.
Prompt notification allows Italygonia Travel, where reasonably possible, to take appropriate action during the experience.
Package travel is also subject to the specific provisions applicable under law.
The customer is responsible for possessing valid documents, authorisations and requirements necessary to participate in the experience.
Where applicable, the customer must independently verify whether identity documents, visas, authorisations or other requirements are necessary.
Italygonia Travel will provide the information it is legally required to provide in connection with the purchased service.
To the extent permitted by law, Italygonia Travel shall not be liable for consequences resulting from the customer’s failure to possess valid or required documents or authorisations.
Communications concerning the booking and the performance of the experience may be made using the contact details provided by the customer, including:
The customer is responsible for ensuring that the contact details provided are accurate and up to date.
The customer must regularly check communications received, including the spam or junk folder of their e-mail account and messages received through WhatsApp.
Italygonia Travel shall not be liable for consequences resulting from the customer’s failure to receive or check communications due to circumstances attributable to the customer, including incorrect or outdated contact details, an unreachable telephone number, a full e-mail inbox, spam filters, lack of internet connection or failure to check messages.
Italygonia Travel accepts customers from any country, subject to any restrictions imposed by law or by the characteristics of the specific experience.
International customers are responsible for independently verifying any requirements necessary to participate in the purchased service.
Mandatory rights granted to consumers under applicable law remain unaffected.
Personal data is processed in accordance with applicable data protection legislation, including Regulation (EU) 2016/679.
The processing methods are described in the Privacy Policy published on the website.
The content published on the website, including texts, photographs, images, logos, graphics, videos and other materials, belongs to Italygonia Travel or is lawfully used by Italygonia Travel.
Reproduction, distribution or use of such content without authorisation is prohibited, except where permitted by law.
Where the website allows customers to publish reviews or other content, customers must publish truthful content and must not infringe the rights of third parties.
Italygonia Travel may remove, to the extent permitted by law, content that is unlawful, offensive, discriminatory, fraudulent or otherwise contrary to the terms governing use of the website.
The relationship between Italygonia Travel and the customer is governed by Italian law, without prejudice to any mandatory provisions that may apply to consumers.
The choice of Italian law does not deprive consumers of mandatory rights that may be granted to them under the applicable legislation.
Italygonia Travel encourages customers to contact it before initiating formal proceedings in order to attempt to resolve any complaint or dispute amicably.
For consumers, mandatory provisions concerning jurisdiction and consumer protection mechanisms under applicable law shall apply.
Nothing in these Terms and Conditions limits the consumer’s right to bring proceedings before a competent court where such right is granted by law.
If any provision of these Terms and Conditions is declared invalid, void or unenforceable, the remaining provisions shall continue to apply to the fullest extent permitted by law.
Italygonia Travel may amend these General Terms and Conditions for legal, organisational, technological or commercial reasons.
The conditions applicable to a booking are those available and accepted by the customer at the time of purchase, except for amendments required by changes in applicable law.
The date of the latest update is indicated at the beginning of this document.
These General Terms and Conditions establish the general rules applicable to purchases made through Italygonia Travel.
The specific conditions stated on the individual experience page and in the booking confirmation form an integral part of the conditions applicable to the relevant service.
In the event of any conflict, the specific conditions prevail over these General Terms and Conditions only with respect to the matters specifically regulated therein.
